EN GENERAL TERMS AND CONDITIONS (GTC) SUN-LOUNGERS.COM AND SUN-LOUNGERS.DE
- Conclusion of Contract and Scope of Application
1.1 The subject of the contract is all deliveries of goods by Sun-Loungers (hereinafter referred to as the “Seller”). These GTC apply exclusively to business customers within the meaning of Section 14 of the German Civil Code (BGB). Consumers are excluded from purchasing via this platform. Any deviating customer terms shall not apply unless expressly agreed.
1.2 These GTC also apply accordingly to the purchase of vouchers, unless otherwise agreed.
1.3 For any design commissions, the GTC of www.muse.de shall also apply in addition to these GTC. - Offers and Conclusion of Contract
2.1 The online shop showcases outdoor furniture and accessories. The product descriptions displayed in the shop constitute invitations to submit an offer by the customer, but are not binding offers.
2.2 The customer submits a binding offer by completing the online order form or by email. Acceptance is usually immediate, but no later than within five days, through a written order confirmation, delivery, or payment request.
2.3 The acceptance period begins on the day following the customer’s submission of the offer and ends on the fifth day thereafter. If the offer is not accepted within this period, the customer is no longer bound by the offer. - Right of Withdrawal
3.1 There is no right of withdrawal, as our offers are directed exclusively to business customers within the meaning of Section 14 BGB. The platform is not intended for consumers as defined by Section 13 BGB.
3.2 The right of withdrawal does not apply to consumers outside the EU without a residence and delivery address within the EU. - Prices, Payment Terms and Shipping Costs
4.1 All prices are quoted as net prices. Turkish VAT (KDV) is only charged for deliveries to customers located in Turkey, if legally required. International B2B orders are VAT-free. Any import duties, customs fees, or local taxes in the destination country are to be borne by the buyer.
4.2 For deliveries outside the EU or to islands, additional costs may apply, which must be borne by the customer (e.g., transfer fees, customs duties).
4.3 The available payment methods are communicated in the shop. Accepted payment methods include: advance bank transfer, PayPal, Amazon Payments, and credit card (VISA, MasterCard, American Express).
4.4 In the case of advance bank transfer, the amount is due immediately. Bank details will be provided after completing the order.

5.1 Delivery will be made to the address specified by the customer. For PayPal or Amazon Payments, the delivery address saved with those services shall apply.
5.2 The risk of accidental loss or deterioration of goods passes to the customer upon handover to the carrier. This applies to both consumers and business customers.
5.3 In case of self-collection by the customer, shipping costs are waived. Collection can take place by prior arrangement at our location [address will be coordinated with the customer in advance]. Please contact our customer service to schedule a collection date.
5.4 Delivery Delays: Please note that delivery may be delayed due to circumstances beyond our control, such as unforeseen events (e.g., natural disasters, wars, political unrest, transport issues, strikes, or force majeure, as well as individual delays from suppliers). In such cases, we will inform you promptly and work together to find a satisfactory solution.
5.5 Retention of Title: The delivered goods remain the property of the Seller until full payment is made. - Additional Services, Design, Planning and Assembly Work
6.1 Special services, such as planning and assembly, design services, 3D renderings, and outdoor area design with furniture from sun-loungers.com, are only carried out based on a clearly agreed additional order. Proper preparation of the installation site is a prerequisite. All additional services are invoiced separately and are payable 50% in advance, 30% upon interim presentation, and 20% upon final delivery or acceptance.
6.2 The Seller’s staff are only authorized to perform services as per the agreed contractual obligations. Any additional work beyond this scope must be agreed upon in writing. Should Seller personnel perform additional work at the customer’s request, this does not alter the contractual relationship. All additional services, including design, will be billed separately. - Reservation Regarding Material Variations
7.1 The use of natural materials such as teak wood may result in commercially acceptable variations in surface appearance. This includes differences in color and grain. Decorative and textile materials may also exhibit minor deviations from sample patterns, especially in color.
Please note that images in the online shop are for illustrative purposes only and may not reflect reality precisely. Variations in materials are part of the unique character of the furniture and do not constitute defects. - Reservation Regarding Image Material
We aim to present all outdoor furniture in realistic settings using our own or supplier-provided image material.
Products depicted in the images are illustrative and not pre-assembled sets offered for sale. Decorative items, flower pots, parasols, or side tables are shown for presentation only and are not included in the purchase price unless explicitly listed as part of the product.
Only the specified item is included in the purchase; visible decorations or other items in the images are not part of the purchase contract. - Warranty and Liability for Defects
9.1 The statutory warranty applies to business customers, with the limitation that the warranty period is one year from delivery. Warranty claims for used goods are excluded.
9.2 Business customers are subject to a limitation period of one year from delivery (for new goods). Claims for used goods are excluded.
9.3 Limitations of liability do not apply in cases of damages, fraudulent concealment of defects, or specific contractual obligations. - Voucher Conditions
10.1 Promotions and vouchers can only be redeemed during the indicated period. Exclusions may apply based on product conditions.
10.2 Vouchers are not redeemable for cash or transferable. - Redemption of Gift Vouchers
11.1 Gift vouchers can be redeemed in the online shop or for style consultations. They may only be used for the purchase of goods, not for other gift vouchers.
11.2 If the gift voucher amount is insufficient to cover the order, another payment method may be used to pay the remaining balance.
11.3 Cash redemption of the voucher value is not possible.
11.4 The voucher can be transferred to another person for a fee of EUR 100. Please contact our support team if you wish to transfer a voucher. - Applicable Law and Jurisdiction
12.1 Turkish law shall apply. Mandatory consumer protection regulations in the EU remain unaffected for deliveries to the EU.
12.2 Jurisdiction is Istanbul, Turkey, unless mandatory legal provisions specify another location.
